When
do I claim a file?
Most people wait too long to begin legal
action in their case. The reason for this is
clearly that they are trying to handle the
case by themselves. Invariably, this proves
to be a
very big
mistake. In fact, if you wait too long, the
statute of limitations could expire and your
claim could be barred forever!
Although many personal injury cases do
settle out of court, that is becoming
increasingly difficult these days. Very
often, suit must be filed in order to obtain
adequate discovery in a case which could
then lead to an alternate form of dispute
resolution like mediation or arbitration.
The bottom line is that you don't want to
risk waiting too long to file because you
could have your case dismissed immediately -
leaving you with nothing!
What
is my case worth?
That depends on a number
of factors, but generally the greater the
medical bills, the greater the value of your
case. Obviously, the more severe your injury
is, the more medical bills you'll have, but
don't wait until the bill collectors start
knocking on your door...act now to get
things started.
There are numerous issues to be resolved
with regard to health insurance, liability
coverage, medpay, underinsured motorist
benefits and Medicaid/Medicare.
The longer you're out of work, the larger
the claim for disability and if your
injuries are permanent, we need to get you
to a qualified medical expert to properly
document that aspect of your claim.
